                               ORDINANCE NO. 10661
                
                
                 AN ORDINANCE CLOSING AND ABANDONING HOLMES ROAD
                 LOCATED SOUTHEAST FROM LEE HIGHWAY, NORTHEAST
                 OF ROBERSON ROAD, MORE PARTICULARLY DESCRIBED
                 HEREIN SUBJECT TO A CONDITION AS SET FORTH
                 HEREIN.
                  
                                                    
                
                
       	    	 SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
       CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
       and abandoned Holmes Road located southeast from Lee Highway,
       northeast of Roberson Road, more particularly described herein,
       and as shown on plat attached hereto and made a part hereof by
       reference:
            Holmes Road, a 40 foot wide unopened right-of-way
            beginning on the southeast line of Lee Highway some 165
            feet northeast of the intersection of the southeast line
            of Lee Highway with the southeast line of Roberson Road,
            thence northeast some 47 feet with Lee Highway, thence
            southeast 592.3 feet to the northwest line of Hickory
            Valley Road, thence northwest some 620 feet to the
            southeast line of Lee Highway, the point of beginning. 
            Said street separates lot 3 and part of lot 9 from lot 4
            and part of lot 8, Hickory Heights Subdivision, as shown
            by plat of record in plat book 8, page 40, ROHC.  Tax
            Map No. 148F-A-21 and 148K-B-5 and 6.
           
           
       	    	 SECTION 2.  BE IT FURTHER ORDAINED, That this closure
       and abandonment is made subject to the following condition:
            1.	 All existing easements are retained.
           
       	    	 SECTION 3.  BE IT FURTHER ORDAINED, That this Ordinance
       shall be effective two (2) weeks from and after its passage as
       provided by law.
